Ocorre que na concepção clássica, em que o instituto contratual consolidouse, o contrato tinha como fundamento principal a doutrina da autonomia da vontade, a qual se desdobrava nos princípios da liberdade contratual, na obrigatoriedade das convenções e na eficácia relativa dos contratos. Com o aparecimento do Estado Social, a nova realidade social exigiu uma releitura da teoria tradicional dos contratos, resultando no surgimento de novos princípios, dentre eles o da função social do contrato. Este defende a prevalência do interesse social em face do particular, e possui respaldo constitucional no princípio da solidariedade e da dignidade da pessoa humana. Sua previsão no ordenamento jurídico brasileiro ocorreu em 2002, com o advento do atual Código Civil, que o impôs como limite do exercício da liberdade de contratar. Sua aplicação depende do juiz, visto que se constitui numa norma aberta, denominada cláusula geral, para a qual o julgador tem liberdade de definir o alcance.One is about boarding on the changes brought to the Civil law for the phenomenon of the socialization of the contractual system, with emphasis in the principle of the social function of the contract. It occurs that in the classic conception, which the contractual institute was consolidated, the contract had as main bedding the doctrine of the autonomy of the will, which if unfolded in the principles of the contractual freedom, in the obligatoriness of the conventions and the relative effectiveness of contracts. With the appearance of the Social State, the new social reality demanded a new reading of the traditional theory of contracts, resulting in the sprouting of new principles, amongst them of the social function of the contract. This defends the prevalence of the social interest in face of the particular one, and possess constitutional endorsement in the principle of the solidarity and of the dignity of the person human. Its forecast in the Brazilian legal system occurred in 2002, with the advent of the current Civil Code, imposed that it as limit of the exercise of the freedom to contract.
