Não obstante, desvencilhou-se a norma regulamentadora dos contornos constitucionais dados ao instituto, quando condicionou seu cabimento à inexistência de outro meio eficaz de sanar a lesividade. Uma breve análise dos diversos posicionamentos doutrinários e jurisprudenciais pode-se identificar os que sustentam que a subsidiariedade da argüição de descumprimento de preceito fundamental, consiste no prévio esgotamento das vias judiciais ordinárias; outros que, dada a feição marcadamente objetiva da ação, o seu caráter subsidiário tem por escopo o preenchimento das lacunas do sistema de controle concentrado de constitucionalidade; por fim, os que asseveram, com esteio nos contornos constitucionais do instituto, a principalidade da argüição de descumprimento.The arguing of violation of basic precept, uncertain in art. 102 § 1° of the Federal Constitution of 1988, and recently regulated by the Law n° 9,882 of December, 3 of 1999, has for target to prevent or to repair injury to the basic precept, resultant of act of the Public Power, as well as its handling is acceptable when the bedding of constitutional controversy on law or federal, state or municipal normative act are relevant, although they are previous to the Constitution. However, the regulation norm was separeted from the constitutional contours given to the institute, when its acceptance was conditioned to the inexistence of another efficient way to repair the injury.
