Discorre-se preliminarmente sobre a origem da Lei, que tinha como base o inciso XLIII, do artigo 5º, da Constituição Federal. O movimento que a influenciou, denominado Movimento da Lei e da Ordem (Law and Order). Disserta-se, também, sobre quais crimes foram escolhidos para aparecerem dentre os tipificados como hediondos, explanando suas conceituações, objetos juridicamente protegidos, sujeitos ativos e passivos, consumação e tentativa. Logo em seguida passa-se a expor a respeito das penas privativas de liberdade, examinando-se os conceitos de pena e analisando-se os princípios constitucionais feridos pela norma, quais sejam, o da legalidade, o da personalidade, o da humanidade e da individualização da pena. Dentre as classificações que a pena possui, foi escolhida somente a de pena privativa de liberdade, pois é a única que admite o instituto da progressão de regime. Sendo este, a essência do presente trabalho, sobre ele são analisadas as correntes doutrinárias e jurisprudências contrárias e favoráveis à progressão do regime integralmente fechado. Ao final é feito um comentário a respeito da Lei nº 11.464/07 que alterou a Lei nº 8.072/90, possibilitando a progressão de regime prisional e, colocando fim a discussão.The present monograph has for target the study of the institute of the progression of regimen of fulfilment of privative penalty of freedom front to the impossibility imposed for § 1º, of the article 2º, the Law nº 8,072 of 25 of July of 1990 - Law of the Hideous Crimes. It is discoursed preliminarily on the origin of the Law, that had as base interpolated proposition XLIII, of the article 5º, of the Federal Constitution. The movement that influenced it, called Movement of the Law and the Order (Law and Order). Disserta, also, on which crimes they had been chosen to appear amongst the tipificados ones as hideous, explanando its active and passive conceptualizations, objects legally proteges, citizens, consumption and attempt. Immediately afterwards is transferred to display it regarding the privative penalties of freedom, examining itself the penalty concepts and analyzing the principles constitutional wounded for the norm, which is, of the legality, of the personality, of the humanity and the individualização of the penalty. Amongst the classifications that the penalty possesss, it was only chosen of privative penalty of freedom, therefore she is the only one that it admits the institute of the regimen progression. Being this, the essence of the present work, on it the doctrinal chains and jurisprudences contrary and favorable to the progression of the integrally closed regimen are analyzed.
