Mediante pesquisa qualitativa, descritiva, indutiva e bibliográfica, além de pesquisas realizadas na doutrina e na jurisprudência concluiu-se que uma das mudanças provocadas com a nova lei diz respeito ao fato de que crianças e adolescentes não poderão permanecer mais do que dois anos nos abrigos de proteção. Além disso, a nova lei regulamentou uma prática que já vinha sendo realizada, a de que era dada preferência para a adoção aos familiares mais próximos como tios, primos e cunhados. Foi destacado ainda que a intenção do legislador em determinar um prazo máximo para a permanência da criança e do adolescente no abrigo teve o intuito de promover a celeridade do processo de adoção. Contudo, a lei não especificou o que poderá acontecer caso esse prazo for atingido. Elucidou-se também que a questão da adoção no Brasil é bastante complexa, já que, para uma criança conseguir ser adotada não basta a intenção do legislador, é preciso que os candidatos a adotantes procurem por crianças fora dos ‘padrões’ por eles mesmos estabelecidos, ou seja, crianças negras e acima de 2 anos de idade. Por fim, concluiu-se que a nova Lei de adoção infelizmente não trouxe a solução para o problema do processo de adoção no Brasil, uma vez que modificaram apenas alguns procedimentos burocráticos, não os solucionando.With the subject “Statute of the Child and the Adolescent and the New Law of Adoption”, the present work of research had for objective to argue on the Statute of the Child and the Adolescent to the light of the New Law of Adoption. By means of research qualitative, descriptive, inductive and bibliographical, beyond research carried through in the doctrine and the jurisprudence one concluded that one of the changes provoked with the new law says respect to the fact of that children and adolescents will not be able to more than remain what two years in the protection shelters. Moreover, the new law regulated one practical one that already it came being carried through, of that she was given preference for the adoption familiar the next ones as uncles, cousins and brothers-in-law. It was detached despite the intention of the legislator in determining a maximum stated period for the permanence of the child and the adolescent in the shelter had intention to promote the celery of the adoption process. However, the law did not specify what this stated period will be able to happen case will be reached. It elucidated also that question of adoption in Brazil is sufficiently complex, since, a child to obtain to be adopted is not enough the intention of the legislator, is necessary that the candidates the adoptive ones look for children are of ‘standards’ for established they themselves, that is, black children and above of 2 years of age.
