Constata a crescente evolução dentro dos direitos mencionados. A doutrina diverge em muitas questões e reflete importantes mudanças acerca de tais institutos. Destaca-se a problemática decorrente do artigo 1.829 do Código Civil em relação ao regime da comunhão parcial de bens havendo bens particulares. Após a análise deste dispositivo por parte de juristas e doutrinadores, os mesmos, passaram a tecer inúmeras divergências acerca do tema. A doutrina majoritária interpreta o artigo de modo a defender que há concorrência dos cônjuges com os descendentes sobre os bens particulares. Ficou evidenciado que Maria Berenice Dias, além de não concordar com a forma mal elaborada do dispositivo, declara que sua aplicação é causa para a ocorrência de inúmeras injustiças. Para solucionar tal impasse foram trazidas análises doutrinárias, projetos de leis sugerindo algumas mudanças, destacando as injustiças trazidas por sua já utilização. Assim, demonstrados prejuízos quanto a sua aplicação, torna-se evidente e imprescindível às mudanças e deferimentos de projetos analisados, sem que para tanto, mais casos injustos sejam evidenciados.Research on the right to family and inheritance law. Notes the growing trend within the duties mentioned. The doctrine differs in many issues and reflects important changes on such institutes. It was problematic under Article 1.829 of the Civil Code regarding the system of community of property with part of private property. After the analysis of this device by lawyers and doctrines, they began to make numerous disagreements about the subject. The doctrine majority interprets the article to argue that there is competition for spouses with children on private property. It was evident that Maria Berenice Dias addition to not agreeing with the form of poorly conceived device, says its application is relevant to the occurrence of many injustices. To resolve this impasse were presented doctrinal analysis, draft laws suggesting some changes, highlighting the injustices brought by its current use.
