Resumo: Busca-se com este estudo entender o que é o Dumping social, bem como que se faça uma análise limitada aos dispositivos que trazem a responsabilidade civil para o ordenamento pátrio, trazer a possibilidade de indenização com caráter punitivo pela prática de dumping social, para enfim entender o enquadramento da questão em estudo neste instituto. Em seguida, será apreciada a função repressiva e punitiva da indenização a ser aplicada em hipótese de ocorrência de dumping social, bem como a possibilidade de imposição ex officio da mesma. Por fim, serão vistos critérios de quantificação do montante, bem como a melhor destinação da verba obtida.
