A família brasileira teve grandes alterações no âmbito legal nas últimas décadas, inclusive com a união estável passando a fazer parte da legislação, vindo a ser amparada no art. 226 da Constituição de 1988 e logo tendo regulamentação especial na Lei nº. 8.971/94 e posteriormente na Lei nº. 9.278/96, que passaram a tratar a união estável como entidade familiar legítima. Muitas famílias que antes estavam à margem da lei passaram a ter oportunidades legais garantidas, com a vigência da Carta Magna, obtendo respeito e proteção do Estado. Mas ainda sendo causa de muitas divergências doutrinárias, jurisprudenciais, surge o novo Código Civil em 2002 em consonância com a Carta Magna trazendo novos conceitos e avanços do novo tipo de família. A família que é a base da sociedade e está sob a proteção do Estado que reconhece a união estável entre o homem e a mulher como entidade familiar. Porém o matrimônio ainda é a principal forma de constituição de família não sendo uma instituição ultrapassada. O desconhecimento da união estável é que passa a ser ignorado sendo garantido aos que optam pela união informal a não legalizada a proteção e respeito do Estado e digna atenção do ente público.The present work has as objective to approach a reflection on the steady union, bringing the innovations appeared after the Federal Constitution of 1988, that they will re-echo in practical the forensic one. The Brazilian family had great alterations in the legal scope in the last decades, also with the steady union starting to be part of the legislation, came to be supported in art. 226 of the Constitution of 1988 and soon having special regulation in the Law nº. 8.971/94 and later in the Law nº. 9.278/96, which they had started to treat the steady union as legitimate familiar entity. Many families who before were to the edge of the law had started to have guaranteed legal chances, with the validity of the "Great Letter", getting respect and protection of the State. But still being cause of many doctrinal divergences, jurisprudential, the new Civil Code was created in 2002 in accord with the "Great Letter" bringing new concepts and advances of the new type of family. The family who is the base of the society and is under the protection of the State that recognizes the steady union between the man and the woman as familiar entity. However the marriage still is the main form of family constitution not being an exceeded institution.
