Resumo: | The purpose of this article, in times of environmental, health and economic crisis, is to discuss the importance of forming and implementing the Socio-environmental Rule of Law for the realization of social and environmental policies. At first, the formation of the Brazilian Socio-environmental State will be contextualized, highlighting its origins and consecration in the constitutional text. Afterwards, the importance of democracy in the construction of the socio-environmental issue in Brazil will be addressed. It will also deal with the way in which social inequality has been unmasked in the face of the deficiencies of social policies as public policies and how the State can prepare for the next crises, where an ecological and systemic vision is even defended. to resolve these crises. For this, the method applied in this article is based on both a theoretical-abstract reflection and an empirical analysis of the event imposed by the new coronavirus and other crises of capitalism. It concludes, showing that there is no way out of these crises except through the strengthening of democracy and the Brazilian Socio-environmental State. |

Em um primeiro momento, será contextualizada a formação do Estado Socioambiental brasileiro, destacando suas origens e consagração no texto constitucional. Após, abordar-se-á a importância da democracia na construção da questão socioambiental no Brasil. Tratar-se-á, também, da forma como a desigualdade social vem sendo desmascarada diante das deficiências das políticas sociais enquanto políticas públicas e como o Estado pode preparar-se para as próximas crises, onde, inclusive, se defende uma visão ecológica e sistêmica para solucionar as mesmas. Para isso, o método aplicado neste artigo tem por base tanto uma reflexão teórico-abstrata, como uma análise empírica sobre o evento imposto pelo novo coronavírus e demais crises do capitalismo.
