The right and access to health: approaches in light of the sustainable development goals in the 2030 agenda

Resumo: The article aims to analyze the national scientific production about the judicialization of health and the relationship with the Sustainable Development Goal 16 of the 2030 Agenda from the review conducted in LILACS and SCIELO databases encompassing articles from 2013 to 2019. The descriptors judicialization of health and right to health or access to essential medicines and health technologies were used. From the predefined inclusion and exclusion criteria, 16 articles were selected to compose the sample. Two categories were obtained as results: right and access to health and the judicialization of health in Brazil. We conclude that, the Judicial Power has been the entrance door of the population to the health system, in increasing proportion, because the absence of possibility of access to health services or products has generated strong impact, generating implications for the government, professionals; health organizations and citizens.

Foram usados os descritores judicialização da saúde e direito à saúde ou acesso a medicamentos essenciais e tecnologias em saúde. A partir dos critérios de inclusão e exclusão predefinidos foram selecionados 16 artigos para compor a amostra. Obtiveram-se como resultados duas categorias: direito e acesso à saúde e a judicialização da saúde no Brasil.
