The reproduction of structural racism in the judiciary

Resumo: The article deals with the importance of implementing the racial quotas policy in the Judiciary, established by Resolution No. 203/2015 of the National Council of Justice (CNJ). The objective was to discuss the need to adopt mechanisms that guarantee racial diversity within the justice system as a way to guarantee the promotion of constitutional values, such as democracy and the plurality of knowledge and experiences, in addition to demonstrating how the Judiciary, as a constituent part of the State, it reproduces structural racism. The research methodology for this work was a bibliographical review of academic studies that evidence racial inequality in the Judiciary Branch, as well as the normative framework that anchors the adoption of the quota policy in that branch. It is concluded, based on the report1 produced by the CNJ from a quantitative survey that aimed to monitor compliance with Resolution No. 203/2015, that after the adoption of the quota policy, there was, in general, an increase in the presence of blacks in the Judicial power.

O objetivo foi discutir a necessidade de adoção de mecanismos que garantam a diversidade racial no âmbito do sistema de justiça como forma de garantir a promoção de valores constitucionais, como a democracia e a pluralidade de saberes e vivências, além de demonstrar como o Poder Judiciário, enquanto parte constituinte do Estado, reproduz o racismo estrutural. A metodologia de pesquisa para este trabalho foi uma revisão bibliográfica dos estudos acadêmicos que evidenciam a desigualdade racial no Poder Judiciário bem como do arcabouço normativo que ancora a adoção da política de cotas no referido poder.
