Brazilian racial dilemmas: the structural racism and the limits and perspectives of Law 12.711/2012

Resumo: To what extent can a law or public policy overcome the structural racism that has historically characterized Brazilian society? The analysis on the affirmative action’s effects for the inclusion of black and brown people in undergraduate courses in Brazil since 2003 was the main objective of this article. Using a methodological approach of bibliographic and documental review and based on results obtained from empirical studies, it was concluded that the affirmative policies for black and brown students in Brazilian public universities had both quantitative (proportion of browns and blacks in universities in relation to proportion in society), and qualitative effects (measured by the inclusion and academic performance of quota holders). Despite this, the quota policy, even denoting an inclusion of blacks and browns in universities, does not represent full social inclusion, as the effects of including these students in the work market or even in the post-graduation courses on the same universities, which are sectors of a civil society marked by an undeniable structural racism, have not yet been measured.

L'analyse des effets des actions positives pour l'inclusion des personnes noires et brunes dans les cours de premier cycle au Brésil depuis 2003 était l'objectif principal de cet article. En utilisant une approche méthodologique de la revue de la littérature et de la revue des documents et sur la base des résultats obtenus d'études empiriques, il a été conclu que les politiques affirmatives de réservation de places pour les étudiants noirs et bruns dans les universités publiques brésiliennes avaient à la fois des effets quantitatifs (proportion de bruns et noirs dans les universités par rapport à la proportion dans la société), et qualitatifs (mesurée par l'inclusion et les résultats scolaires des détenteurs de quotas). Malgré cela, la politique des quotas, même dénotant une inclusion des noirs et des bruns dans les universités, ne représente pas la pleine inclusion sociale, car les effets sur l'inclusion de ces étudiants dans le marché du travail, ou même dans les cycles supérieurs de ces mêmes universités, n'ont pas encore été mesurés, secteurs d'une société civile marquée par un racisme structurel indéniable.Até que ponto uma lei ou uma política pública pode superar o racismo estrutural que caracteriza historicamente a sociedade brasileira? A análise dos efeitos das ações afirmativas para a inclusão de pessoas pretas e pardas nos cursos de graduação no Brasil a partir do ano de 2003 foi o objetivo principal do presente artigo. Utilizando-se uma abordagem metodológica de revisão de literatura e de revisão documental, com base em resultados obtidos de estudos empíricos, chegou-se à conclusão de que as políticas afirmativas de reserva de vagas para estudantes pretos e pardos nas universidades públicas brasileiras surtiram efeitos, tanto quantitativos (proporção de pardos e pretos nas universidades em relação à proporção na sociedade), quanto qualitativos (medidos pela inclusão e pelo desempenho acadêmico dos cotistas).
