The “protector of women's causes”: Nelson Carneiro's Divorce Laws (1951-1977)

Resumo: This article deals with the theme of divorce in Brazil, based on the construction of Nelson Carneiro's image as a “defender of women's causes”. In 1977, a full divorce was approved, and civil marriage became dissolvable. Before that, the National Congress received different proposals at different periods in the history of Brazil, so that some characters were essential in breaking the marital bond, such as Senator Nelson Carneiro who, for 26 years, was at the head of the divorce wing. On the way to the approval of divorce in Brazil, political disputes occurred between the ones who were for and against the theme. These debates addressed issues of family and marriage, with women and children being identified as the main “victims” of divorce or possible divorce. The investigated sources are the legal, legislative texts and, above all, the works written by Nelson Carneiro.

Em 1977 o divórcio pleno é aprovado, e o casamento civil passa a ser dissolúvel. Antes disso, o Congresso Nacional recebeu diferentes propostas em distintos períodos da História do Brasil, de modo que alguns personagens foram fundamentais para a quebra do vínculo conjugal, como o Senador Nelson Carneiro que, por 26 anos, esteve à frente da ala divorcista. Nos caminhos para a aprovação do divórcio no Brasil, ocorreram disputas políticas entre os favoráveis e os contrários ao tema. Esses debates abordavam questões sobre a família e o casamento, sendo apontados como as principais “vítimas” de um desquite ou de um possível divórcio, as mulheres e os filhos.
