Reflections on flexibilization of in itinerehours and sustainable development

Resumo: The concentration of industries in urban centers attract the need for more infrastructure and transport, given the failure of public transportation, individuals choose to use their individual vehicles. Alternative could be the installation of manufacturing facilities in remote locations, however, there are several viable economic hardship for it. The hours commuting, for example, arise from CLT - Consolidation of Labor Laws - are obliged to pay the employee for the time spent in commuting to the company installed in place of difficult access or not served by public transport and vice versa, always that transportation is provided by the employer. Obligation, to some extent, has given rise to overcrowding of large centers and a combination of events indicates that the harm brought by the measure are greatly larger than the benefits, allowing a determination of need for reassessment of the obligation imposed by the standard that encourages labor the development of urban areas at the expense of other regions of the country.

Alternativa poderia ser a instalação de parques fabris em localidades remotas, entretanto, diversas são as dificuldades econômicas para viabilizá-la. As horas in itinere, por exemplo, decorrem da CLT – Consolidação das Leis do Trabalho – e constituem obrigação de pagamento ao empregado pelo tempo despendido no deslocamento até a empresa instalada em local de difícil acesso ou não servida por transporte público e vice-versa, sempre que o transporte for fornecido pelo empregador. Referida obrigação, em certa medida, tem dado causa à superlotação de grandes centros.
