Resumo: This article aims to analyze the crisis now facing the jurisdictional task of conflict resolution and realization of fundamental rights in our legal system, proposing a bailout social participation and mainly concern with the social, given that, despite the individualism represent a ideology arising from the early days, today was named modern, individualistic essence seems to be even sharper, which should undoubtedly be revised, since it presupposes the future prosperity and not backwards.
