Resumo: Produced in the scope of the studies onCollective Material Law Theory andhaving as a theoretical framework theconclusions of Robert Alexy, especiallythose found in the Theory ofFundamental Rights, this paper willexamine the right to state prestations as atool for effectiveness of human rightsenshrined in the Brazilian Constitution.Emphasis will be placed on positiveprestations. Thus, the present exploratoryresearch, which adopts as its procedurebibliographic review and uses as itsmethod of inference deductive reasoning,will seek to validate the hypothesis of therealization of fundamental rights bymeans of the state’s commissive actionfor the fulfillment of prestations.

Dar-se-á ênfase para as prestações positivas.
