Bullying in schools: who is responsible?

Resumo: Democratic participation in society has grown thanks to modern technological advances, permitting political discussions of relevant issues scattered all across the globe. Moreover, largely ignored social ills are explored in profound ways in soap operas, films and other medias available to the general public. Among these socially relegated issues is bullying, a practice that is attracting attention from law enforcement and is the central theme of NETFLIX's 13 Reasons Why series. In this context, this paper examines who is legally responsible for bullying conducts among school children and adolescents. Moreover, this paper points out the duty of the family, school and the State in antibullying education. In order to research this topic, this study utilizes literature review of websites and electronic journals that have a qualitative, descriptive and exploratory nature, whilst observing production limits of scientific articles.

Várias mazelas sociais, ignoradas por muitos, são tratadas de maneira profunda através de novelas, filmes e outros mecanismos disponíveis ao público. Entre essas moléstias, relegadas socialmente, está o bullying, que atrai a atenção do Direito e foi retratado pela série 13 Reasons Why, da NETFLIX. Assim, a presente pesquisa se faz importante para identificar alguns dos civilmente responsáveis pelas práticas de bullying entre crianças e adolescentes no seio escolar, apontando a responsabilidade da família, da escola e do Estado na educação antibullying e a importância desses atores na coibição desta prática nociva.
