The Mariana and Brumadinho cases: critical analysis on labor and social security consequences of major work acidentes

Resumo: Based on a general understanding of the environmental legal system and its applications to labor law, this article will address the major labor, social and environmental tragedies thathave recently occurred in Minas Gerais, with the collapse of the mining tailings dams in Mariana and Brumadinho, seeking contextualize them as a problem that needs to be understood under the following methodological itinerary: contextualize tragedies as major accidents at work, promoting a critical analysis of their labor and social security aspects. The details of these two cases will be analyzed, considered the most paradigmatic among those judged by the Labor Court in matters of environmental labor law, promoting a careful approach to the facts and the procedural processing of these lawsuits that have as their object environmental, social and collectives of that case, concluding by the affirmation of the human right to a safe and healthy work environment, as well as warning for the observance of the tutelary rules regarding that subject. To carry out the research, the deductive method was adopted as the approach method and the bibliographic research technique as the procedure method, based on doctrine and legislation relevant to the matter.

To carry out the research, the deductive method was adopted as the approach method and the bibliographic research technique as the procedure method, based on doctrine and legislation relevant to the matter.Partindo da compreensão geral do sistema jurídico-ambiental e de suas aplicações ao direito do trabalho, este artigo abordará as grandes tragédias trabalhistas, sociais e ambientais ocorridas recentemente em Minas Gerais, com os rompimentos das barragens de rejeitos de mineração em Mariana e Brumadinho, buscando contextualizá-los como uma problemática que necessita ser compreendida sob o seguinte itinerário metodológico: contextualizar as tragédias enquanto grandes acidentes de trabalho, promovendo uma análise crítica dos seus aspectos trabalhistas e previdenciários. Serão analisados os detalhes destes dois casos, considerados os mais paradigmáticos entre aqueles julgados pela Justiça do Trabalho em matéria de direito ambiental do trabalho, promovendo uma abordagem cuidadosa dos fatos e da tramitação processual destas ações judiciais que tem como objeto os danos ambientais, sociais e coletivos do referido caso, concluindo pela afirmação dos direito humanos ao meio ambiente do trabalho seguro e saudável, bem como alerta para a observância das regras tutelares quanto àquele tema.
