The regulatory model of the electric energy compensation system

Resumo: This article seeks to clarify the Brazilian regulation of the electric energy compensation system, identifying constitutional foundations for its applications and the perspective of the solar energy in relation to other renewable energy sources that compose  the national energy matrix. With the attribution of the power competence set to the respective Regulatory Agency, ANEEL Normative Resolution No. 482/2012 is identified as the current legislation, despite its temporariness. With the comparative law demonstration, the favorable and opposite aspects that the changes would represent is brought to discussion. The base methodology for explaining the theme was bibliographic research, which followed the article’s own linearity. The challenges refer to the doctrinal scarcity of the theme, which led to a consultation of some technical articles for more information. Concluding, reducing the benefits of joining the compensation system would only slow down the growth of the sector.

Concluding, reducing the benefits of joining the compensation system would only slow down the growth of the sector.Investiga-se a regulação brasileira referente ao sistema de compensação de energia elétrica, identificando os fundamentos constitucionais para a sua aplicação e o panorama da energia solar frente às demais fontes renováveis de energia que já compõem a matriz energética nacional. Inicialmente, ocupa-se em apresentar a tratativa constitucional acerca da energia elétrica, seguindo com a competência atribuída pela Constituição da República à respectiva Agência Reguladora. Subsequentemente, identifica-se que o instituto do ordenamento brasileiro que trata da compensação é a Resolução Normativa nº 482/2012 da ANEEL, responsável também por evidenciar o seu caráter temporário. Explorando as abordagens da matéria adotadas no direito comparado, finalmente, expõem-se as influências favoráveis e contrárias que as alterações representariam ao setor. A metodologia base para a explanação dos tópicos selecionados foi a pesquisa bibliográfica, realizada em conformidade à ordem linear do raciocínio apresentado. Os desafios encontrados giram substancialmente em torno da escassez doutrinária referente ao tema, resultando em informações extraídas em grande parte de artigos técnicos.
