Ideology in brazilian judicial discourse

Resumo: Based on the definition of law as “a vehicle for transferring bourgeois illusions”, formulated by Márcio B. Naves, this study investigates the dominant (bourgeois) aimed at protecting and preserving privileges, supported by a legal language in national legislation. These elements will be recognized by analyzing a case study (Case / law court), where vehicles that defines class institutes are exemplarily marked. One aspect of this discursive protection is observed in the legal language whose vocabulary is based on a framework of understanding far popular and protected by a linguistic normalization that sets up in a very specific universe this domain, and the reform of the Institute of property, in modernity, without letting go of its classic attributes.

Naves, investigaremos o discurso dominante (burguês) voltado à proteção e manutenção de privilégios, sustentados por uma linguagem jurídica propalaga na legislação nacional. Estes elementos serão reconhecidos pela análise tecida a um estudo de caso (acórdão/jurisprudência de tribunal), onde os veículos de cautelamento aos institutos de classe estão exemplarmente demarcados.
