The importance of prior environmental impact study in the approval of genetically modified organisms in Brazil

Resumo: This paper examines the importance of a prior Environmental Impact Study when approving genetically modified organisms (GMOs) and their derivatives. With this in mind, this paper explores the Act n° 11.105/2005, its objectives and normative structure, as it is the primary legal instrument that authorizes the use of GMOs. Moreover, it also regulates the process for its release in the environment. Furthermore, this study analyzes the complexities of GMOs; their environmental impact; characteristics; influences; and legal dictates. Finally, this research concludes that there should be Environmental Impact Studies when analyzing transgenic products. Our chosen methodology was literature review with deductive reasoning.

Será explorada a Lei 11.105/2005 em sua estrutura quanto aos órgãos responsáveis na autorização desses organismos e os procedimentos administrativos de autorização para liberação daqueles no meio ambiente. Posteriormente, será analisada a questão do impacto ambiental, explanando suas características e influências nas normas jurídicas, concluindo pela necessidade do Estudo Prévio de Impacto Ambiental quanto à autorização da transgenia no meio em geral.
