Resumo: This article aimed to examine under the approach of law and economics, the legal institute of chattel mortgage in the real estate market, which was established by Federal Law no. 9514/1997. This institute was compared to the ordinary mortgage. It was verified the existence of data showing the reduction of default rates concernig the credit granted and guaranteed by the Institute of liens, as well as increasing of legal certainty in the forcement of the chattel mortgage,  in comparison with the difficulties encountered for the forcement of the ordinary mortgage,showing an economic efficiency.
