Between new public management (npm) and postnpm: govtechs of documental management at the perspective of the fundamental right to acess to information

Resumo: This paper examines the parameters of the fundamental right of access to information in govtechs. Furthermore,its hypothesis is that this right should be a top priority of theBrazilian government when there are partnerships between it andgovtechs. Moreover, this research understands that regulatorymechanisms should be used to intervene in cases of violation ofthese rights. This study utilizes the hypothetical-deductive method with the qualitative approach and the bibliographic-documentary research technique. This research finds, firstly, that govtechscan be understood, in Brazil, from the context of a new formof transition between new public management (NPM) and postNPM. Therefore, assumptions of complete transfers of publicservices are false because it does not sell but pursuits partnerships with the public sector, whilst maintaining characteristicsof their own sector (although there is still a significant legacyof NPM in Brazil, given that the proposed managerialism underpinned extensive privatization and privatization processes,to the extent that post-NPM initiatives work in an ambiguousscenario). Furthermore, the link between private initiative andpublic administration within the scope of govtechs requires thatthe fundamental right of access to information be respected andpromoted from a normative and regulatory framework, as wellbe the promise of these companies. Therefore, the application ofthe right of access to information to document management govtechs is important, and this paper understands that most modernmanagement systems contribute to the effectiveness of this right.

Nesse sentido, sua hipótese é a de que a aplicação do direito fundamental ao acesso à informação deve ter primazia nos casos da parceria entre Administração Pública e govtech, devendo os mecanismos de regulação serem utilizados para exercer intervenção em casos de desrespeito a tal direito. Foi utilizado o método de procedimento hipotético-dedutivo, com abordagem qualitativa e técnica de pesquisa bibliográfico-documental para a sua elaboração. Como resultados, tem-se, primeiramente, que as govtechs podem ser compreendidas no cenário brasileiro na transição entre new public management (NPM) e post-NPM, negando parte das premissas de completa transferência da prestação de serviços públicos, incorporando noções de parceria com o setor público, mantendo características próprias em cada setor (embora haja um legado ainda relevante da NPM no Estado Brasileiro, tendo em vista que o gerencialismo proposto fez bases nos amplos processos de desestatização e privatizações, ao ponto que as iniciativas de post-NPM trabalham em um cenário ambíguo). Ademais, a ligação entre iniciativa privada e Administração Pública no âmbito das govtechs exige que o direito fundamental ao acesso à informação seja respeitado e promovido, sendo este o marco normativo e regulatório, bem como a promessa dessas empresas.
