Resumo: The article makes a panoramic approach to the processby which the incidence of the principle of privaty of contract hasbeen mitigated, systematizing this process in two central aspects.The first is the opposability of the contract, which recognizes therepercussions of the contract before third parties, exemplified bythe STJ’s summary 308 and by the so-called external protectionof credit. The second is the extension of the concept of part,by virtue of the conjugation of the adoption of the dynamic orevolutionary definition of part with the admission of parts byforce of law, as occurs in the stipulation in benefit of third partyand in linked contracts. This approach reveals the arguments putforward in the various cases of balancing between the principle of privaty in front of other principles of contractual law.

O primeiro é a oponibilidade dos efeitos do contrato, que reconhece repercussões próprias do contrato perante terceiros, exemplificado pela súmula 308 do STJ e pela chamada tutela externa do crédito. O segundo é a ampliação do conceito de parte, em virtude da conjugação da adoção da definição dinâmica ou evolutiva de parte com a admissão de partes por força de lei, como ocorre na estipulação de terceiro e nas conexões entre contratos.
