Business sustainability from the point of view of the methodology of economic analysis of law: protective inefficacy of traditional legal analysis

Resumo: The contemporary company has taken on new and important roles in the Democratic Rule of Law, and in this new guise, profit, despite its indispensability in the context of business activity, is no longer the exclusive objective to be pursued. The relationships built with the community, the environment, consumers and workers became part of the concept of “economic efficiency”, constituting an effective instrument for promoting sustainable development and configuring a differential element in the competitive market. This paper explores this apparent conflict, to verify its effects and the possibility of facing it with an Economic Analysis of Law by understanding that this method, in addition to the insufficiency of traditional legal analysis, offers concrete possibilities when linking environmental protection with economic decision-making. This paper utilizes literature review in conjunction with the deductive approach, as it is a theoretical and conceptual-normative analysis.

As relações construídas junto à comunidade, meio ambiente, consumidores e trabalhadores passaram a fazer parte do conceito de “eficiência econômica”, constituindo eficaz instrumento de promoção do desenvolvimento sustentável e configurador de diferencial competitivo diante do mercado concorrencial. O presente artigo pretende compreender este aparente conflito, verificar seus efeitos e a possibilidade de enfrentá-lo através da Análise Econômica do Direito pela compreensão que esse método, para além da insuficiência da análise jurídica tradicional, oferece possibilidades concretas de vincular a proteção ambiental quando das tomadas de decisões econômicas.
