In democratic societies, citizens transfer their wishes to elected representatives; however, it goes without notice that active participation is not possible if the population lacks environmental education and access to information. In light of this, this paper addresses the relationship between representative democracies; the right to information and education; and the reflection of this in the judiciary branch – who is a protector of the liberties and rights of the Federal Constitution. Moreover, an effective justice needs to be prompt in guaranteeing these issues because for environmental questions, a lawsuit´s duration plays a crucial role. This research used the hermeneutic method and the technique of bibliographical research.
