SOCIAL REGRESSION, ACCESS TO JUSTICE AND DEMOCRACY

Resumo: This paper defends the thesis that in a democratic constitutional state the principle of prohibition of social regression can’t be disregarded, as it is within the legal system, although implicitly, and in case of its violation it is possible to resort to the Judiciary in search for its effectiveness. Otherwise, access to justice would not be guaranteed and, therefore, democracy could no longer be talked about. The research was developed by the descriptive and bibliographic documentary method.

The research was developed by the descriptive and bibliographic documentary method.En este trabajo se defiende la tesis de que en un Estado constitucional democrático el principio de prohibición de retroceso social no puede ser desconsiderado, pues él está dentro del sistema jurídico, aunque implícitamente, y en caso de su violación es posible recurrir al Judicial en busca de su efectividad. Se así no fuera, no se garantiría el acceso a la justicia y, así, ya no sería posible hablar en democracia. La investigación se desarrolló mediante el método documental descriptivo y bibliográfico.Neste trabalho defende-se a tese de que, em um Estado Constitucional Democrático, o princípio de proibição de retrocesso social não pode ser desconsiderado, pois referido princípio está inserido no sistema jurídico, ainda que implicitamente, e, em caso de sua violação, é possível recorrer ao Judiciário em busca de sua efetividade. Do contrário, não se garantiria o acesso à justiça e, assim, já não se poderia falar em democracia.
