The need for restricted publicity of procedural acts in cases of health insurance: on behalf of protecting consumer intimacy

Resumo: | Democratic ideals present in the Brazilian Constitution of 1988, should be incorporated into norms and into procedural practice, as it is not particularly appropriate to sacrifice dignity for the literal fulfillment of procedural law norms. As there are cases in which procedural publicity can compromise personality rights, especially the right to intimacy, and as the risks of transgression of these rights are even greater when dealing with healthcare plans, this paper aims to verify if it is necessary to establish restricted publicity of procedural acts in cases of health insurance. For this purpose, the scientific method chosen was qualitative studies, utilizing observation, collection and analysis of bibliographic and documentary data of the principle of procedural publicity and health plan contracts; and this research used inductive-deductive method to confront procedural guarantees in relation to the right to intimacy. |

Como há casos em que a publicidade processual pode comprometer os direitos da personalidade, especialmente a intimidade, e como os riscos de transgressão a esses direitos são maiores quando se trata de lides envolvendo planos de saúde, o artigo tem como objetivo verificar se é necessário se estabelecer a publicidade restrita dos atos processuais nos casos de plano de saúde.
