Resumo: Este artigo tem por objetivo abordar os limites e restrições aos direitos fundamentais de acordo com a teoria constitucional. Apresenta ainda considerações sobre a teoria da argumentação clássica e o papel do princípio da proporcionalidade na solução de conflitos entre direitos fundamentais.
