O DILEMA DA NATUREZA DAS REDES SOCIAIS: EMPRESAS DE COMUNICAÇÃO COM ATIVIDADE EDITORIAL OU PRAÇA PÚBLICA DA ATUALIDADE?

With the advent of social networks, much has been discussed about their revolutionary role in human communications. These platforms emerged with the intention of serving as an environment of freedom where anyone could expose all kinds of ideas, as long as some limits determined by their internal policies were observed. In this sense, these large social networks were once considered the public square of our times, however, as was to be expected from an environment free of regulation, while this brought greater access to information, it also brought abuse of fundamental rights. . In this scenario, we are witnessing proactive behavior on the part of social networks in order to keep their environment less toxic and, for that, they are increasingly removing content considered to be hateful or false, which would constitute editorial conduct. It is in this aspect that we propose a discussion on the nature of social networks and their respective governing legislation, since, as we noted, these companies are in a legal limbo where they enjoy the benefits of exclusion of responsibility for published content, but do not need to submit to the regulatory practice of its economic activity, just like any other traditional communication company.
