Special Education policies in dispute: analysis of the Decree no. 10,502/2020

Resumo: The National Policy on Special Education: Equitable, Inclusive and with Lifelong Learning (NSPE2020) was approved by Decree no. 10,502, of September 30, 2020, and later judged by the Direct Action of Unconstitutionality no. 6,590 of the Supreme Court. Thus, in this work, the construction process until the document is suspended is described, which was analyzed with the help of the Iramuteq software, in order to understand its constituent elements. The results allow us to conclude that the NSPE2020 is split when considering the target audience to which it is intended: a) deaf people; and b) other students of the Special Education Target Audience. The Decree was in force for about 60 days, caused controversy, was suspended but caused division in the struggle for the right to education. The construction and dissemination process illustrates the importance of the collective construction of a public policy and the involvement of society and, above all, of the people for whom such legislation is intended. Iramuteq.La Política Nacional de Educación Especial: Equitativa, Inclusiva y con Aprendizaje a lo Largo de la Vida (PNEE-2020) fue aprobada por el Decreto No. 10.502, del 30 de setiembre de 2020, y, posteriormente, juzgada por la Acción Directa de Inconstitucionalidad No. 6.590 del Supremo Tribunal Federal. Así siendo, en este trabajo, se describe el proceso de construcción hasta la suspensión del documento, lo que fue analizado con la ayuda del software Iramuteq, con el fin de comprender sus elementos constitutivos. Los resultados permiten concluir que la PNEE2020 es bipartita cuando se considera el público al que se destina: a) personas sordas y b) demás estudiantes que forman el público de la Educación Especial. El Decreto tuvo vigencia por cerca de 60 días, causó polémica, fue suspendido, y dividió el movimiento de lucha por el derecho a la educación. El proceso ilustra la importancia de la construcción colectiva de una política pública y de la implicación de la sociedad y, sobre todo, de las personas a quien se destina dicha legislación. Os resultados permitem concluir que a PNEE-2020 é bipartida quando se considera o público-alvo ao qual se destina: a) pessoas surdas; e b) demais estudantes do público-alvo da Educação Especial. O Decreto vigorou por cerca de 60 dias, causou polêmica, foi suspenso e dividiu o movimento de luta pelo direito à educação. O processo ilustra a importância da construção coletiva de uma política pública e do envolvimento da sociedade e, sobretudo, das pessoas a quem se destina tal legislação.
