Resumo: | This article analyzes the divergences and convergences on the treatment of research data and the investigative field of Human and Social Sciences, in Resolution no. 466/2012, in Resolution no. 510/2016 and the General Data Protection Law (LGPD). This is a documentary investigation, with a qualitative approach and exploratory objective, based on the understanding of the theorists De La Fare, Carvalho and Pereira (2017), Mainardes (2017) and Peixoto (2017). The results indicate: i) the lack of determinants linked to human integrity; ii) the lack of autonomy of the research subject; iii) the need to modernize data processing resolutions; iv) the need for the researched subject to access the investigation results, as well as the transparency of access to his/her data; v) the need to fertilize teaching and an ethical culture in educational institutions. Se trata de una investigación documental, con abordaje cualitativo y objetivo exploratorio, basada en el entendimiento de los teóricos De La Fare, Carvalho y Pereira (2017), Mainardes (2017) y Peixoto (2017). Los resultados indican: i) la falta de determinantes vinculados a la integridad humana; ii) la falta de autonomía del sujeto investigador; iii) la necesidad de modernización de las resoluciones de tratamiento de datos; iv) la necesidad de acceso del sujeto investigado a los resultados de la investigación, así como la transparencia del acceso a sus datos; v) la necesidad de fecundar una enseñanza y una cultura ética en las instituciones de educación. Trata-se de uma pesquisa documental, de abordagem qualitativa e objetivo exploratório, balizada no entendimento dos teóricos De La Fare, Carvalho e Pereira (2017), Mainardes (2017) e Peixoto (2017). Os resultados apontam: i) a falta de determinantes vinculados à integridade humana; ii) a falta de autonomia do sujeito pesquisador; iii) a necessidade de modernização das resoluções no tratamento de dados; iv) a necessidade do acesso do sujeito pesquisado aos resultados da investigação assim como da transparência do acesso aos seus dados; v) a necessidade de fecundar um ensino e uma cultura ética nas instituições de educação.
