Democratic management in the legal frameworks of municipalities in the state of Maranhão: an analysis of the laws of the Municipal Councils of Education

Resumo: This paper analyzes how the principle of democratic management, established in the Federal Constitution of 1988 and in the National Education Guidelines and Framework Law no. 9.394/1996, is included in the Laws of creation of the Municipal Councils of Education –(called CME) from Barreirinhas, Codó and Icatu, municipalities of the State of Maranhão, Brazil. For the development of this paper, we used bibliographical, documentary research and data related to the research done by the National Union of Municipal Councils of Education (called UNCME), in 2015, on the institutionalization and functioning of CME in Maranhão. We found that the laws of the CME of the municipalities surveyed do not explicitly bring the principle of democratic management into practice. The absence of such a principle, as part of the management of the Municipal Education System, can hamper the strengthening of spaces of participation, construction of autonomy, decentralization of local power and exercise of citizenship within the municipality.   Keywords: Democratic Management. Legislation.En este artículo se analiza cómo el principio de la gestión democrática, dispuesto en la Constitución Federal de 1988 y en la Ley de Directrices y Bases de la Educación -Ley nº 9.394/1996, consta en las leyes de creación de los Consejos Municipales de Educación (CME) de Barreirinhas, Codó e Icatu, municipios en el estado de Maranhão. Para desarrollo del texto, se utilizó la investigación bibliográfica, documental y datos referentes a la investigación efectuada por la Unión Nacional de los Consejos Municipales de Educación (UNCME), en 2015, sobre la institucionalización y el funcionamiento de los CME en Maranhão. Se constató que las leyes de los CME de los municipios investigados no traen, explícitamente, el principio de la gestión democrática. La ausencia de tal principio, como parte de la gestión del sistema municipal de educación, puede perjudicar el fortalecimiento de los espacios de participación, de construcción de la autonomía, de descentralización del poder local y de ejercicio de la ciudadanía en el ámbito del municipio.   Palabras clave: Gestión Democrática. Legislación.O presente artigo analisa como o princípio da gestão democrática, disposto na Constituição Federal de 1988 e na Lei de Diretrizes e Bases da Educação – Lei Nº 9.394/1996, figura nas leis de criação dos Conselhos Municipais de Educação (CME) de Barreirinhas, Codó e Icatu, municípios do Estado do Maranhão. Para o desenvolvimento do texto, utilizou-se pesquisa bibliográfica, documental e dados referentes à pesquisa realizada pela União Nacional dos Conselhos Municipais de Educação (UNCME), em 2015, sobre a institucionalização e o funcionamento dos CME no Maranhão. Constatou-se que as leis dos CME dos municípios pesquisados não trazem, explicitamente, o princípio da gestão democrática.  A ausência de tal princípio, como parte da gestão do Sistema Municipal de Educação, pode prejudicar o fortalecimento dos espaços de participação, de construção da autonomia, de descentralização do poder local e de exercício da cidadania no âmbito do município.   Palavras-chave: Gestão Democrática.
