Resumo: The present investigation intends to show how the Brazilian prison population has been increasing substantially during the last years, especially about women, who are the hardest hit by Law 11.343/06, the new Drug Law. Thus, we sought to list the main reasons that led them into drug trafficking, as well as their sociodemographic profile and their participation in this illegal trade. In addition, a brief critical analysis about the Drug Law will be exposed, notably due to the penal selectivity imbricated in its provisions. Thus, we also investigate the conditions of prisons in relation to their infrastructure, which is not appropriate for the female body, which has several specificities that international human rights treaties and constitutional principles aim to protect. To achieve the goal, the research methodology is based on a bibliographical and documentary review, developed through a survey of books, scientific articles, as well as the analysis of international human rights treaties and the Constitution of the Republic of 1988.

Assim, busca-se elencar os principais motivos que as levam a adentrar no tráfico de drogas, bem como analisar seu perfil sociodemográfico e entender de que forma atuam nesse comércio ilegal. Além disso, será exposta uma breve análise crítica acerca da Lei de Drogas, notadamente em virtude da seletividade penal imbricada em suas disposições. Por fim, investiga-se também as condições das unidades prisionais em relação a sua infraestrutura e nota-se que ela é inapropriada para o corpo feminino, pois ele possui diversas especificidades amparadas por tratados internacionais de direitos humanos e princípios constitucionais.
