DOI: 10.12957/dep.2015.15911Resumo O presente artigo traz as discussões históricas em torno do parecer que Hans Kelsen, convidado pela revista brasileira “Política: revista de direito público, legislação social e economia”, deu sobre o decreto que regulava o fundamento da Assembleia Nacional Constituinte de 1933-1934. A intenção é reconstruir detalhes jurídicos e políticos importantes do período e resgatar o texto e o contexto da publicação do autor austríaco no Brasil. Considerando tais elementos, o artigo indica novos caminhos de interpretação sobre a recepção do pensamento do autor na academia e política brasileiras. Ao final do artigo, apresento o parecer no original alemão e a tradução publicada pela revista no Brasil. Palavras-chave: Hans Kelsen; Constituinte brasileira 1933-1934; Assembleia Nacional Constituinte; Soberania; Competência Abstract This paper presents the historical discussions on the opinion that Hans Kelsen, invited by the Brazilian magazine "policy: public magazine, social legislation and economy," fell upon the decree that regulated the foundation of the National Congress of 1933-1934. The intention is to rebuild legal and political details of the period and rescue the text and the context of the publication of the Austrian author in Brazil. Considering these elements, the article indicates new interpretation paths on receipt of the author's thinking in academia and Brazilian politics. At the end of the article presents the opinion of the German original and the translation published by the magazine in Brazil.
