DOI: 10.1590/2179-8966/2017/25624 Resumo O artigo propõe-se a realizar um estudo sobre a Convenção 169 da OIT de 1989 no contexto brasileiro, questionando se as comunidades de terreiros de matriz africana estão amparadas sob sua tutela. Em decorrência disso, foi necessário perquirir se o termo “povos tribais”, lá contido, encontra-se atualizado perante as legislações subsequentes que defendem a diversidade cultural e a proteção de minorias sociais. Assim, se perpassa o debate sobre o mecanismo da autoidentificação carregado naquela Convenção e o histórico da legislação que lhe sucedeu sob o enfoque da necessária proteção à identidade individual e grupal. Ao cabo do presente texto, conclui-se que é plenamente justificável o enquadramento das comunidades dos terreiros de matriz africana sob o manto de proteção da Convenção 169 da OIT. Abstract The article proposes to conduct a study on the ILO Convention 169 of 1989 in the brazilian context, questioning whether those with african roots terreiro communities are supported under his tutelage. As a result, it was necessary to assert the term "tribal people", contained therein, is updated before the subsequent laws that defend cultural diversity and the protection of social minorities. Thus, it runs through the debate on the self-identification of the loaded mechanism that Convention and the history of the legislation that succeeded it from the standpoint of the necessary protection of individual and group identity. At the end of this text, it is concluded that it is fully justified the framework of communities of African origin terreiros under the cloak of protection of Convention 169 of the ILO.
