DOI: 10.1590/2179-8966/2017/24970ResumoO presente trabalho pretende abordar de forma panorâmica o pensamento do jurista Otto Kirchheimer. Em um primeiro momento, busca-se relacionar o pensamento do jurista com a tradição da Teoria Crítica da Sociedade – conhecida também como “Escola de Frankfurt” -, cuja influência é marcante ao longo de toda sua produção acadêmica. Posteriormente, o foco residirá na crítica que Kirchheimer faz ao direito penal nacional-socialista enquanto instrumento de eliminação dos adversários políticos. Por fim, a partir da tipologia construída por Kirchheimer no texto “Justiça Política”, serão abordadas possíveis contribuições do pensamento do jurista alemão ao contexto jurídico atual.Palavras-chaves: Justiça política; Nacional-socialismo; Teoria crítica.AbstractThis work aims to provide an overview of the juristic thinking of Otto Kirchheimer. At first, will be tried to relate Kirchheimer’s thought with the tradition of Critical Theory of Society - known as "Frankfurt School" - whose influence is striking throughout his academic production. Later, the focus will lie in the critic that Kirchheimer made against the National Socialist and his criminal law as instrument related to the elimination of political opponents. Finally, considering the typology built by Kirchheimer in the text "Political Justice," will be discussed the possible contributions of his thinking in the current legal context.Keywords: Critical theory; National-socialism; Political justice.
