Resolutive municipal support in the processing of collective conflicts: access to justice and participation in the extrajudicial processes of resolution and monitoring of collective conflicts in the Mineiro Triangle

Resumo: AbstractThrough a hypothetical-deductive approach, this work has as scope the practical-procedural mapping of institutionality and municipal resolving equipment in dealing with collective conflicts, discussing the capacity and institutional importance of this federative level in promoting the extrajudicial resolution of such controversies. The methodological tools used were based on [hypothetical], statistical and bibliographic case study procedures. With this, the hypotheses that the municipalities of Minas Gerais (and in deduction, the Brazilians) do not have institutional resolution support to subsidize the best out-of-court resolution of social conflicts and that, they also enjoy a strategic position in promoting access to justice, have been duly discussed and confirmed, with the result that only 1 out of a total of 66 municipalities has established a Municipal Conciliation Chamber at legislative level, it is possible to observe a situation of helplessness in the legal process of the transindividual conflicts. In this way, it contributes to the development of the theme while denouncing the organizational disruption and the omission of the public-administrative agenda in relation to the resolution, discussion and extrajudicial participation of collective conflicts on a municipal scale, thus demonstrating the importance of overcoming this state of affairs contrary to democratic ideals.
