DOI: 10.12957/rqi.2018.30842 O artigo tem como objetivo analisar a função das instituições do sistema de justiça brasileiras diante do fenômeno dos ciclos das políticas públicas, tratando das possibilidades de defesa das ações afirmativas e do combate ao racismo institucional e cultural. Inicialmente, o trabalho apresenta um caso de judicialização de uma política pública cultural afirmativa. Em seguida, o texto se divide em três tópicos: a) a compreensão dos ciclos das políticas públicas: uma ferramenta para além dos enunciados textuais, em que se aborda a necessidade do jurista visualizar as políticas públicas além da clausura do direito; b) as instituições jurídicas brasileiras e o racismo institucional e cultura, em que debate o fenômeno do racismo, de maneira a superar a limitação do racismo individual; c) a política pública no banco dos réus: um exemplo de judicialização e incompreensão judiciária: ações afirmativas culturais, momento em que se apresenta um caso concreto de judicialização de políticas culturais afirmativas. Como resultados e considerações, o artigo apresenta conclusões no sentido de visibilizar a necessidade das instituições jurídicas enfrentarem o racismo institucional. A metodologia utilizada é a revisão crítica de literatura, com a análise documental de processo judicial.  Palavras-Chave: Ações afirmativas; Racismo institucional e cultural; Inclusão e juristas.AbstractThe purpose of the present article is the analysis of the role of the Brazilian legal system institutions in what touches the phenomenon of public policy cycles by means of approaching the possibilities regarding the defense of affirmative action and the fight against both institutional and cultural racism.  Initially, the article presents a case on judicialization of a cultural affirmative public policy. Then follows the subdivision of the text in three topics: a) the comprehension of the cycles of public policy: an instrument which surpasses mere textual statements , where is discussed the jurists' need of realizing public policy externally to the legal cloister; b) the Brazilian legal institutions and the institutional and cultural racism, where is discussed the phenomenon of racism in the sense of overcoming the boundaries of individual racism; c)the public policy in the dock: an example of judicialization and judiciary incomprehension: cultural affirmative action, where is presented a case of judicialization of cultural affirmative policies. The methodology concerns the critical revision of relevant literature as well as the documental analysis of a legal case.Keywords: Affirmative Action; Institutional and Cultural Racism; Inclusion; Jurists.
