Resumo: The improper omission is undoubtedly a tortuous subject in Criminal Law, as are the aspects related to subjective imputation, especially when trying to define the concept of eventual intention. This paper seeks to investigate the intersection between these two topics, that is, the compatibility or not of criminal liability for the eventual intention in crimes of improper omissions. The path to be followed begins with the distinction between proper and improper omissive crimes, later moving on to discuss the legal foundations that justify the typical equivalence between commissive and omissive behavior. Subsequently, the assumptions of the objective typicality of improper omission are addressed. The requirements for material grounds of the guarantor position are analyzed, as well as the legal contours of the typical risk situation and the need to delimit the omitted action. The discussions on causality and objective imputation in the case of improper omission are further investigated, notably with regard to the confrontation between the theories of avoidability and risk reduction. Once all the premises concerning improper omission have been established, the study focuses on the study of malice, going through the currently dominant theories, of a volitional nature, to subsequently enter into the study of the cognitive approaches. It departs from this analysis to reach the points of tension between the theories, exposing the main criticisms directed at the volitional theories and the possible incompatibilities of the cognitive approaches with the Brazilian legal system. Finally, from all the theoretical products derived from the exposure made throughout the work, we arrive at the chapter dedicated to the conclusion of the dissertation. In summary, the possible answers on the compatibility or not of improper omission with eventual intention are exposed, which is done considering not only the dominant theories on the elements of subjective and objective imputation but also the minority theories, in order to achieve the greatest possible dogmatic yield in this investigation.

Este trabalho busca investigar uma interseção entre esses dois temas, qual seja, a compatibilidade ou não da responsabilização penal a título de dolo eventual nos delitos omissivos impróprios. O caminho percorrido se inicia com a distinção entre os crimes omissivos próprios e impróprios, posteriormente avançando para a discussão acerca dos fundamentos jurídicos que justificam a equiparação típica entre um comportamento comissivo e um comportamento omissivo em relação ao resultado. Em momento posterior, abordam-se os pressupostos de tipicidade objetiva da omissão imprópria. São analisados os requisitos de fundamentação material da posição de garantidor, os contornos jurídicos da situação típica de risco e a necessidade de delimitação da ação omitida, investigando-se, ainda, as questões acerca da causalidade e da imputação objetiva na omissão imprópria, notadamente no que tange ao confronto entre as teorias da evitabilidade e da diminuição dos riscos. Uma vez estabelecidas todas as premissas concernentes à omissão imprópria, o trabalho se debruça sobre um estudo das teorias do dolo, perpassando pelas correntes atualmente dominantes, de cariz volitivo, para posteriormente adentrar no estudo das teorias cognitivas. Parte-se dessa análise para chegar aos pontos de tensão entre as teorias, expondo-se as principais críticas a elas dirigidas, bem como analisando possíveis incompatibilidades com o ordenamento jurídico brasileiro. Por fim, a partir de todo o produto teórico oriundo da exposição feita ao longo do trabalho, chega-se ao capítulo dedicado à conclusão da dissertação.
