This paper presents a study of the legal protection of the environment, specifically the use of the criminal branch. As nature is an important legal right for the viability of human life and the perpetuation of the species, it remains clear the importance of protecting normative value of this constitutionally protected. Once in the Constitution of the Federative Republic of Brazil in 1988, there is a constitutional order for the environment to be subject to supervision by the branches civil, administrative and criminal. However, the coexistence of these spheres for the same purpose meets certain practical problems and technical. After a historical, political, social and philosophical environmental protection, the dissertation discusses the various legal frameworks that ensure the perpetuation of green for future generations and their maintenance for the citizens of today. After a study of the various elements of civil and administrative law, the criminal is specifically examined. This approach covers both doctrines national, and international. The study of Comparative Law presents all the forms and possibilities of environmental protection through criminal law, verifying its necessity, appropriateness and feasibility for both.
