As mudanças climáticas e a proteção internacional dos “refugiados ambientais”

The worsening of global warming will significantly increase the number of humanitarian crises in the world, with more and more people needing help because of events related to climate emergency. Thus, the issue of "environmental refugees" is a relevant topic worldwide today, since several countries suffer the consequences of climate change caused by human action and are marked by internal and external displacement of a large contingent of people to other regions, which impacts the countries or places receiving this flow of people. In this sense, the purpose of this work was to analyze the possible meanings of the term "environmental refugees" in International Public Law, in order to implement a specific protection. The thesis was developed from a qualitative, exploratory research, using the deductive method, through a bibliographic and documental review, by gathering pertinent legislation. To this end, firstly, it was sought to understand how anthropic activities influence and/or aggravate the global climate crisis and its repercussions on International Environmental Law. Subsequently, possible frameworks for the concept of "environmental refugees" were verified with respect to the terms: "refugee", "migration" and "displacement". Finally, specific norms of Public International Law and of certain States were analyzed, all of which can be applied for the protection of this portion of the population, not yet legally defined. As a result, it was possible to perceive that a joint cooperation between countries is necessary to put an end to this legal limbo, and it was proposed the institution of a binding international agreement as the best option for the protection of "environmental refugees" which, due to the difficulties of negotiation between countries, should be achieved through the initial implementation of regional instruments and bilateral agreements.
