This thesis affirms labor as a founding category in the social being's ontology, and by being an essentially human achievement, whose importance determines life, and as such, must be a mobilizing axis in educational processes. However, the nature of labor, such as presented, evidences a contradiction: if, on one hand we can classify labor as founding in human life, on the other hand, capitalism turns it into a merchandise, product of the accumulation of capital and merchandise, turned into wage labor, alienated, fetishized. In this way, we identify, in the relations of means of production in the capitalistic system, child's labor as alienated work and as a mean of exploitation, analyzing, among the objective and subjective assumptions, how work has been used as the salvation of a infancy that would be morally abandoned , from the beginning of the industrialization process in Brazil, in the period understood as the end of the 19th century until mid of the 20th century, which constitute historical landmarks in the insertion of children and adolescent labor from urban lower classes. The study of these assumptions, which define children and adolescents in their political and cultural processes, the denial of childhood as a social right, and the different types of childhood, social and culturally built, will be analyzed here. We try to understand how the network of meaning is established and the perception of cultural patterns, how the social relations are woven and their clashes in the formation of a new relationship between children and teens with work in its educational principle and not in the productive conduction of value exchange. We also seek to identify and analyze the possible mediations in democracy, in capitalist society, in assuring public policies that fight child labor, analyzing the theoretical and practical challenges of the Conselhos de Direitos da Criança e do Adolescente, in making, implementing and controlling these policies and we affirm the non- centrality of this theme in the Conselhos de Direitos, as well as the incompatibility between the focusing and the universalizing public policies. With it, we affirm that the early insertion of children and the unprotected insertion of teenagers in the workforce does not dignify them or contributes to their emancipation as a social subject, but does can make their future as a leftover in the capitalistic relations of production more likely
