Resumo: | OBJECTIVE: To analyze article 131 of the Statute of the Child and Adolescent, according to which it is the responsibility of the Guardianship Council to ensure the fulfillment of the rights of children and adolescents provided for in the Statute of the Child and Adolescent. METHOD: Regarding the level, the research is exploratory, since the main objective is to provide affinity with the object of study. As for the approach, the present study has a qualitative character, it works with the universe of meanings, motives, values and attitudes, which corresponds to the deeper study of the relations. The data collection procedure was carried out through bibliographic research, in which it seeks to respond to the problem situation using already published sources on the subject, such as doctrines and scientific articles, and documenetal research, based on legislation. RESULTS: The rights of children and adolescents began to be valued and respected based on the social achievements of international movements that sought to protect and fulfill human rights. In Brazil, abandoned children were under the responsibility of municipalities until the mid-nineteenth century, when the Children's Code of Brazil. From the Federal Constitution/1988 and the Statute of the Child and Adolescent/1990, the rights of children and adolescents were guaranteed. Child is the person who is 12 years old incomplete and teenager is the one who is between 12 years and 18 years of age, complete. CONCLUSION: It can be verified that there are many responsibilities of the Tutelary Council, which requires continuous training, as well as a deep knowledge of the demands and needs of the specific community to which it is linked. The duty of the Board of Trustees to ensure the fulfillment of the fundamental rights of the child and the adolescent, established by article 131 of the Statute of the Child and Adolescent, is to protect the interests of the Child and Adolescent, whenever the Rights recognized in Law are threatened or violated by action or omission of society, the State, abuse of parents or responsible. |

MÉTODO: Quanto ao nível, a pesquisa é exploratória, pois o principal objetivo é proporcionar afinidade com o objeto de estudo. Quanto à abordagem, o presente estudo tem caráter qualitativo, trabalha com o universo de significados, motivos, valores e atitudes, o que corresponde ao estudo mais profundo das relações. O procedimento de coletas de dados ocorreu por meio da pesquisa bibliográfica, em que busca responder a situação problema utilizando-se fontes já publicadas sobre o tema, como doutrinas e artigos científicos, e da pesquisa documental, baseada na legislação. RESULTADOS: Os direitos da criança e do adolescente passaram a ser valorizados e respeitados a partir das conquistas sociais de movimentos internacionais que buscavam a proteção e a efetivação dos direitos humanos. No Brasil, as crianças abandonadas ficavam sob a responsabilidade dos municípios, até meados do século XIX, quando surgiu o Código de Menores do Brasil. A partir da Constituição Federal/1988 e do Estatuto da Criança e do Adolescente/1990 passou-se a garantir os direitos da criança e do adolescente. Criança é a pessoa que tem até 12 anos incompletos e adolescente é o que tem entre 12 anos e 18 anos de idade, completos. CONCLUSÃO: Pode-se verificar que são muitas as atribuições do Conselho Tutelar, o que exige uma capacitação continuada, além de conhecimento profundo das demandas e necessidades da comunidade específica à qual está vinculado.
