The purpose of this work is to analyze, under the Brazilian Law, the concept of “legitimate interest”, which is a validity requirement for all kinds of insurance policies, according to the main section of Article 757 of the Brazilian Civil Code. In order to study this subject, it is relevant to examine the moral opposition that the historical development of insurance has undergone. It will also be analyzed the relevance of the insurable interest requirement in order to prevent moral hazard. Based on these assumptions, the paper will investigate the legal concept of “interest”, especially in the insurance field, and the meaning of the adjective “legitimate”, set forth as a validity requirement for any insurable interest under the Brazilian Law. In the end, the work will analyze specific issues related to several kinds of insurance policies and the practical repercussion of the “legitimate interest” requirement within the so called “directors and officers liability insurance” (D&O insurance).
