Resumo: This paper intends to analyze the growing land regularization promotion trends currently in course in the carioca favelas. The aim is to study the causes, the content and the objectives of the mechanism, in order to understand its paradoxical results encompassing the promotion and denial of fundamental rights to dwellers of these areas. In addition to the analysis of the implementation of social interest land regularization in the carioca favelas, this paper seeks to explain the role of public policies towards overcoming the antinomies inherent to the mechanism, ensuring the fundamental rights to said inhabitants. Some specific public policies were emphasized and deeply analyzed, such as the increase of public participation, subsidies to regularization costs and education for the proper comprehension of the new framing and value of the regularized land. Therefore, this paper expects to contribute for the improvement of social interest land regularization within the carioca favelas, minimizing its practical effects involving denial of rights and maximizing the assurance of fundamental rights to dwellers of these locations.

O objetivo é estudar as causas, o conteúdo e os objetivos do instituto a fim de compreender seus resultados antinômicos de promoção e negação de direitos fundamentais para a população residente nestas áreas. Além da análise sobre a implementação da regularização fundiária de interesse social nas favelas cariocas, pretende-se demonstrar o papel das políticas públicas na superação da antinomia inerente ao instituto, garantindo os direitos fundamentais dos moradores destas áreas. Algumas políticas específicas foram destacadas para análise mais detida, como as de incremento da participação popular, subsídios para os custos decorrentes da regularização dos imóveis e educação para a devida compreensão do novo enquadramento e valor da propriedade já regularizada.
