Resumo: This research aims to approach the concept of psychopathy, sociopathy, antisocial personality disorder or dyssocial personality disorder, and its possible legal consequences and philosophical premises. For such a task, it is analyzed according to three branches of knowledge: Medicine and Psychology, Jurisprudence and Critical Criminology and Philosophy. Inside the medical and psychological branch, it is studied its origin, the main authors who arranged the concept as it is known nowadays and the experts' proposals towards the psychopaths. Inside the Jurisprudence and Critical Criminology branch, with the theory developed by Michel Foucault, it is questioned what is a mental disorder, the search for an organic cause of the moral behavior and what is a crime. Inside the philosophical branch, the concept of psychopathy is compared to the theory of evil in Plato, Aristotle, Immanuel Kant and a radical opposition to Friedrich Nietzsche's theory is exposed. It is verified that the concept of psychopathy is contradictory, fundamentally moralizing and developed under a social arrangement project.

It is verified that the concept of psychopathy is contradictory, fundamentally moralizing and developed under a social arrangement project.A presente pesquisa visa abordar o conceito de psicopatia, sociopatia, transtorno de personalidade antissocial ou transtorno de personalidade dissocial, suas possíveis repercussões no direito e suas premissas filosóficas. Para tal, é analisado dentro de três campos de saber: a Medicina e a Psicologia, o Direito e a Criminologia Crítica e a Filosofia. Dentro do saber médico e psicológico, são estudadas sua origem, os principais autores que estruturam o conceito tal como se conhece atualmente e as propostas dos peritos voltadas aos psicopatas. Dentro do saber jurídico e criminológico crítico, com a teoria de Michel Foucault, é questionado o que é doença mental, a busca para uma causa orgânica dos comportamentos morais e o que é crime. Dentro do saber filosófico, compara-se o conceito de psicopatia com a teoria do mal em Platão, Aristóteles e Immanuel Kant e faz-se uma contraposição radical com Friedrich Nietzsche.
