Resumo: The right to a nationality represents the bond between the individual and the State. Statelessness results from the absence of this link, either by not acquiring or by losing nationality. There are several reasons why an individual may become stateless, however, many cases, especially those considered difficult and lengthy, have the same root: discrimination. The nationality laws, in some States, still present discriminatory aspects, mainly related to gender. In this sense, this paper aims to discuss the relationship between statelessness and gender discrimination, as well as the advances and challenges faced in combating statelessness.

A apatridia decorre da ausência deste vínculo, seja pela não aquisição ou pela perda da nacionalidade. Existem diversos motivos que levam o indivíduo a se tornar apátrida, entretanto, muitos casos, especialmente aqueles considerados difíceis e demorados, possuem a mesma raiz: a discriminação. As leis de nacionalidade, em alguns Estados, ainda, apresentam vertentes discriminatórias, principalmente relacionadas ao gênero.
