Access to education emancipates people, awakens self-awareness and the world, reveals rights and indicates paths for their realization, which presupposes being present in the school environment. Menstruating teenagers, without proper menstrual hygiene items, do not go to school. In this context, the purpose of the article is to analyze the effect that the menstrual phenomenon causes girls' access to education and, with such an assumption, whether this occurrence justifies the institution of a public policy that offers these menstrual hygiene articles for the realization of the social right the education. The methodology used was a critical qualitative and exploratory approach to current scientific and academic production on the subject, accompanied by the analysis of data related to the topic, collected by official entities and organized civil society. It was concluded that, in fact, there is an obstacle to the satisfactory access of girls and women to menstrual hygiene items; which severely affects the access of this population, among others, to the social right to education; which legitimizes the establishment of a public policy to address this need, as an instrument for the realization of the fundamental human right to gender equality.
