Challenges in Identifying Public Domain Patents in Brazil

The present study aims to identify the circumstances that lead a patent application/patent to the public domain in Brazil, and how many of the patent applications/patents filed in Brazil are under such circumstances. Using a qualitative-quantitative approach, the applied research with a descriptive and exploratory nature established a correspondence between Law No. 9.279/1996 and the Patent Orders Code Table used by the Brazilian National Institute of Industrial Property (INPI) through a textual review of the two documents. The result was the delimitation of 13 circumstances and the identification of 137,665 processes filed in the country between 1990 and June 2022 in this scenario. Throughout the study, challenges arising from the uncertainty generated by the ambiguous and generic descriptions of some orders codes and the lack of official information and data on the subject were also examined.
