The Performance and Tendencies of Green Patents in the Legal Amazon

Resumo: The study aims to identify the green technologies that are being protected and the respective areas of interest to universities, research institutions, companies and inventors within the Legal Amazon. This descriptive and quantitative study identified trends in protected green technologies in the Amazon region through the mapping of deposits with the Instituto Nacional da Propriedade Industrial (INPI) between April 2012 and December 2020. The study showed few green patent deposits, with individuals as the main depositors. It was found that clear and objective writing is a difficulty to be overcome while technologies related to waste management are predominant. The result demonstrates that the Amazon region has not appropriated this mechanism in order to take advantage of its potential for sustainable development. The policies instituted and the incentive mechanisms established were not able to encourage green patents as a modifier of the economic situation in the region.

Este estudo descritivo e quantitativo possibilitou a identificação das tendências de tecnologias verdes protegidas na região amazônica por meio do mapeamento dos depósitos junto ao Instituto Nacional da Propriedade Industrial (INPI) entre abril de 2012 e dezembro de 2020. O estudo demonstrou poucos depósitos de patentes verdes, sendo que as pessoas físicas são as principais depositantes. A técnica da redação clara e objetiva é uma dificuldade a ser superada enquanto as tecnologias relacionadas ao gerenciamento de resíduos são predominantes. O resultado demonstra que a região amazônica não se apropriou desse mecanismo de forma a aproveitar seu potencial frente ao desenvolvimento sustentável.
